(PROHIBITION OF WAITING) No.02 ORDER 2019

 

                                             Road Traffic Regulation Act 1984

 

THE KENT COUNTY COUNCIL acting as the local Traffic Authority and in exercise of its powers under Sections 1, 2, 32, 35, 36, 45, 46, 47, 49, 53 and 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (hereinafter referred to as ‘the Act’), the Traffic Management Act 2004, the Civil Enforcement of Parking Contraventions (England) General Regulations 2007 and of all other enabling powers, and after consultation with the chief officer of police in accordance with Part III of Schedule 9 to the Act, hereby make the above named Order:-

Due to the construction of Bishops Chavasse Primary School, it has become necessary to implement or amend the waiting restrictions in Five Oak Green Road in the Borough of Tunbridge Wells;

FIVE OAK GREEN ROAD – DYL (1) On the north side, from its junction with Woodgate Way for a distance of 186 metres in a westerly direction to its boundary with Tonbridge & Malling Borough Council. (2) (spur); DYL On both sides for a distance of 7 metres in a northerly direction. (3) On the south-side from its junction with Woodgate Way for a distance of 126 metres in a north-westerly direction. (4) On the south side from a point 167 metres southwest of its junction with Woodgate Way in a south-westerly direction for a distance of 15 metres. (5) On the south side from a point 208 metres southwest of its junction with Woodgate Way in a south-westerly direction for a distance of 22 metres.

The Order was made on 13 May and its provisions will come into effect on 20 May 2019.

Anyone may, by application to the High Court within 6 weeks of the date of publication of this Notice, challenge the validity of the Orders or of any provision contained in them on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or any instrument made thereunder, or that there has been a failure to comply with any statutory requirement to the Orders.
